Terms and Conditions
1. The contest is open to all legal Australian residents, 18 and older as of the start of the Contest. Persons who are employees (and those with whom such employees are domiciled) or agents of the Sponsor, its franchisees or their advertising and promotional agencies and the Contest Judges, are not eligible.
2. Prizes: There will be one (1) Grand Prize consisting of a $1000 dollar shopping spree. Prize must be redeemed by August 30, 2010. We will notify you via email. The $1000 shopping spree will confirm a date and a store to redeem and must be spent in one day. The prize will be drawn at random from the eligible email addresses submitted. Only ONE entry allowed per person. Any duplicate entries will be ignored.
3. By entering the competition, entrants will be deemed to have read and understood these rules and be bound by them. Prize must be accepted as awarded, and are not transferable, assignable, or redeemable for cash. No prize may be substituted, except by Sponsor in its sole discretion. Sponsor reserves the right at any time to substitute a prize or any portion thereof for a prize of equal or greater value. Any cost associated with redeeming the shopping spree or the delivery of prize is the sole responsibility of the winner.
4. Winners will be announced via www.villaandhutblog.com on May 25, 2010. If a winner is disqualified or determined to be ineligible, or if a prize is unclaimed or undeliverable, an alternate winner will be selected using the same judging process/criteria described above. Alternate winners are subject to all requirements set forth in these Official Rules.
5. Entries must be made on the Site by the authorized account holder of the e-mail address submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, internet domain owner, or other person or organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. The Sponsor reserves the right to verify the validity and originality of any entry and/or entrant (including an entrant’s identity and address) and to disqualify any entrant who submits an entry that is not in accordance with these Official Rules or who tampers with the entry process. Failure by Sponsor to enforce any of its rights at any stage does not constitute a waiver of those rights.
6. Limitation of Liability: Sponsor is NOT responsible for: printing or typographical errors in any related materials; stolen or fraudulent entries or mail; or transactions that are processed or lost due to computer or electronic malfunction. Each winner is solely responsible for payment of all federal, state, and local taxes on prize. Sponsor reserves the right to cancel or modify Contest if fraud or technical failure compromises the integrity of the Contest as determined by Sponsor in its sole discretion.
7. Prizes are awarded without warranty of any kind from Sponsor, express or implied, without limitation, except where this would be contrary to federal, state, provincial, or local laws or regulations. All federal, state, provincial and local laws and regulations apply. Submission of entry into this Contest deems that entrants agree to be bound by the terms of these Official Rules and by the decisions of Sponsor, which are final and binding on all matters pertaining to this Contest. Return of any prize/prize notification may result in disqualification and selection of an alternate winner. Any potential winner who cannot be contacted within 15 days of attempted first notification will forfeit his/her prize. Failure to comply within this time period may result in disqualification and selection of an alternate winner. Acceptance of the prize constitutes permission for, and winners consent to, Sponsor and its agencies to use a winner’s name and/or likeness and entry for advertising and promotional purposes without additional compensation. $1000 prize excludes cost of shipping and delivery of prize items. It is the responsibility of the winner to arrange their own transportation to Villa & Hut Homewares to redeem the prize.
8. NO RECOURSE TO JUDICIAL OR OTHER PROCEDURES: To the extent permitted by law, the rights to litigate, to seek injunctive relief or to make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this contest are hereby excluded, and any participant expressly waives any and all such rights.
9. Participants agree that personal data, especially name and address, may be processed, stored and otherwise used for the purposes and within the context of the contest and any other purposes outlined in these Official Rules. The data may also be used by the Sponsor in order to check participants’ identity, their postal address and telephone number, or to otherwise verify their eligibility to participate in the Contest and to receive any prize. If participant’s data is not provided or is canceled participants’ Entries will be ineligible.
10. Sponsor is not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission. Sponsor is not responsible for theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind. Sponsor is not responsible for inaccurate transmissions of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any Web site or any combination thereof, except to the extent that any death or personal injury is caused by the negligence of the Sponsor. If for any reason the Internet portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest. Sponsor reserves the right to select winners from eligible entries received as of the termination date. Sponsor further reserves the right to disqualify any individual who tampers with the entry process. Caution: Any attempt by a contestant to deliberately damage any Web site or undermine the legitimate operation of the game is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such contestant to the fullest extent of the law.
